Pradith v. Ashcroft:
Davone von Pradith, a Laotian national with legal permanent
resident status in the U.S., was in the custody of Immigration and Customs
Enforcement pending his deportation. This office petitioned the U.S.
District Court in Portland, OR for a
Writ of Habeas Corpus, requesting Pradith to be released from custody. The
Court granted the Writ of Habeas Corpus and ordered his immediate release.

In
an appeal case filed by this office, the
Ninth Circuit Court said that 8 USC 1252(a)(2)(B)(ii) did not bar judicial review of the
Attorney General (US CIS)'s discretionary decision to revoke a previously
approved EB-1 visa petition.
